A bench of Justice Samir Jain pronounced the order after hearing arguments of the different parties involved in the case.
The case stemmed from a first information report (FIR) filed in 2019 against Azam Khan’s wife Tazeen Fatma, his son and former MLA Abdullah Azam and Syed Jafar Ali Jafri. The FIR was filed by Revenue Inspector Angraj Singh and accused them of grabbing the bar, as per news agency PTI.
Azam Khan was not named in the FIR then, but later the case was reinvestigated after five years and he was named as an accused in the case.
In another development, Khan was acquitted by a special MP-MLA court last week in a 17-year-old case related to road blockade and damage to public property, as per PTI.
Khan had allegedly created a ruckus and caused disturbance near Chhajlet police station in 2008 after the police removed the hooter from his car.
Khan and his supporters had blocked the road and caused a traffic jam. The protests reportedly turned violent which witnessed damage to some electric poles. This led to a registration of a case against him.
Security heightened, gatherings not allowed
Anticipating a huge crowd gathering in support of Khan, before his release on September 23, the district administration imposed prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in Sitapur to prevent any violence or any such incident.
The police also used drone for surveillance amid heightened security.

A large number of Khan’s supporters reached near the jail in their vehicles, which caused traffic congestion. Following this, the Sitapur traffic police issued challans to several vehicles that had gathered in violation of restrictions.
“There was chaos and rush despite Section 163 being in force. Vehicles were not allowed to come close to the jail, but they somehow managed to reach there. Action had to be taken to avoid further complications,” City Circle Officer Vinayak Bhosle was quoted as saying by PTI.
‘All cases against Azam will be withdrawn if…’
SP chief and MP Akhilesh Yadav hailed the court’s decision and Azam’s release from jail. “SP leader Azam Khan has been released from jail. I would like to thank the Court for this. We, the Samajwadis, believed that the Court would do justice. We hope that in the time to come, no false cases will be filed and no injustice will be done by the BJP; an officer was given extension after extension. This is a matter of joy for the Samajwadis that he has been released,” Yadav told reporters, as per ANI.
“Azam Khan and Samajwadis have played a major role in facing BJP for a long time now. We hope that in the time to come, all his cases will be finished. The manner in which the CM withdrew cases against him and the Deputy CM as well as BJP leaders, after SP forms Government, all false cases against Azam Khan will be withdrawn,” he added.
