
Additional Solicitor General SV Raju informed the Supreme Court that the Delhi School Education (Transparency in Fixing and Regulation of Fees Act, 2025, will not be implemented for the ongoing academic year 2025-26, as per LiveLaw.
The Supreme Court had earlier said that the government should not implement the law retrospectively.
The new law aims to regulate private school fees in Delhi and was notified in December 2025.
The apex court ordered that no directions from it was required after the government’s clarification and directed that further issues can be raised in the Delhi High Court.
“When the matter came before us our concern was the hurry in implementation. We would have set that aside. But they said that we will do it from next year. To that extent our interference at this stage is over,” Justice Narasimha said, as per LiveLaw.
“In view of the clarification of Mr ASG Raju and the learned counsel for the authority Director of Education that the legal regime will not be implemented w.e.f. 2025-26, no further orders are required. All questions are kept open for being raised before the High Court,” the court ordered.
The new law mandates approval by a two-tier regulatory framework consisting of district-level appellate authorities and school-level committees, for increase in fees charged by private schools.
