
The Delhi High Court on Thursday, October 9, ordered the Election Commission of India (ECI) to allot a common election symbol to the Akhil Bharatiya Jan Sangh for the upcoming Bihar legislative assembly elections, Bar and Bench reported.
The order was passed by Justice Mini Pushkarna.
The court directed the party to submit an application to the ECI in accordance with the Election Symbols (Reservation and Allotment) Order.
“Subject to the petitioner complying with the said direction, it is directed that a common symbol shall be allotted forthwith to the petitioner to contest the state assembly election of Bihar,” the bench stated.
The Akhil Bharatiya Jan Sangh, registered in 1989 and claiming origins in the Bharatiya Jana Sangh, had challenged the ECI’s September 1 communication rejecting its request for a symbol. The party contended that the refusal infringed on its constitutional and statutory rights, citing erroneous reasoning and absence of internal disputes, as alleged by the ECI.
This marks the second time the party approached the High Court after its earlier petition led the Court to direct the ECI to consider its August 25 representation expeditiously. Advocates Pranay Ranjan and Mrigank Prabhakar represented the petitioner.
